These Terms and Conditions (“Terms”) govern your use of the Site and the lead generation services operated by Innovation Digital Marketing (“Site Operator,” “We,” “Us,” or “Our”) in connection with our local service partners, primarily J Creek Electric, LLC (“Primary Service Partner”).

By accessing or using the Site, submitting a lead form, or calling any phone number displayed on the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access the Site or use our services.

1. Definitions

  • Site: Refers to the website Asheville Electrical Contractors, including all content, phone routing systems, forms, and digital features.
  • Site Operator: Refers to Innovation Digital Marketing, the business entity that owns, manages, and maintains the digital marketing platform and lead collection systems.
  • Local Service Provider: Refers to the independent, licensed local electrical contractors who contract with or receive leads from the Site Operator, primarily J Creek Electric, LLC.
  • Services: The lead generation and routing services provided by Innovation Digital Marketing, which collect user contact and electrical service requests and transmit them to Local Service Providers.

2. Nature of Service and Lead Generation Disclaimer

  • Lead Generation Platform: Innovation Digital Marketing is a digital marketing and lead generation agency, not a licensed electrical contractor. We do not directly perform electrical work, issue quotes on site, or execute service contracts.
  • Independent Contractors: Any Local Service Provider (including J Creek Electric, LLC) contacted through this Site operates as an independent business. Innovation Digital Marketing does not employ, control, or act as a legal agent for the Local Service Provider.
  • User Vetting Responsibility: You are solely responsible for evaluating and verifying the credentials, licensing, bonding, insurance, and reputation of any Local Service Provider before entering into a contract or permitting work on your property.
  • Limitation of Contractor Liability: Innovation Digital Marketing is not liable for disputes, property damage, delays, defective workmanship, injuries, or financial loss resulting from services provided or omitted by a Local Service Provider. Your sole legal recourse for service or billing issues is directly with the contractor who performed the work.

3. Telephone, SMS, and Communication Consent (TCPA Compliance)

By submitting your phone number on a web form or calling any phone number displayed on this Site, you provide your express written consent to the following communication terms:

  • Consent to Contact: You authorize Innovation Digital Marketing and J Creek Electric, LLC (or designated local fulfillment partners) to contact you via telephone, text message (SMS/MMS), or email regarding your electrical inquiry, even if your telephone number is listed on a state or national Do Not Call registry.

4. Intellectual Property Rights

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INNOVATION DIGITAL MARKETING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING PROPERTY DAMAGE, PERSONAL INJURY, LOST PROFITS, OR DATA LOSS) ARISING FROM YOUR USE OF THE SITE, RELIANCE ON SITE CONTENT, OR ANY INTERACTIONS, CONTRACTS, OR SERVICES RENDERED BY LOCAL SERVICE PROVIDERS (INCLUDING J CREEK ELECTRIC, LLC).

You agree to defend, indemnify, and hold harmless Innovation Digital Marketing, J Creek Electric, LLC, and their respective officers, directors, employees, agents, and partners from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of or access to the Site and its communication channels.
  • Your violation of any provision of these Terms.
  • Your contractual agreements, disputes, or transactions with any Local Service Provider connected through the Site.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising under or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in North Carolina, and you hereby consent to personal jurisdiction and venue therein.

10. Modifications to Terms

Innovation Digital Marketing reserves the right to modify, update, or revise these Terms at any time. Any changes will take effect immediately upon being posted on the Site with an updated “Last Updated” date. Your continued use of the Site following the posting of changes constitutes acceptance of those revisions.
